Perhaps the best way
to start this introduction is to quote from the "Consumer and Business
Affairs Victoria, Associations Incorporation Act 1981, No. 9713, INFORMATION
BOOKLET":
There are in the community, many unincorporated associations. They are as
diverse in their size as they are in the activities, which their members
pursue and considered together, play a very significant part in community
life. However, the Law with respect to unincorporated associations has developed
many uncertainties especially in the following situations-
• The devise of property to unincorporated associations.
• The ability of associations to contract and hold property.
• The liability of committee members of associations.
Incorporation would remove those uncertainties and the Associations Incorporations
Act 1981 was passed to provide a simple, inexpensive system so that unincorporated
associations may incorporate.
While the Associations Incorporation Act is designed to permit incorporation, the choice of whether to do so will remain with the members of an unincorporated association.
Some of the
benefits to be obtained from incorporation are:
• The liability of an incorporated association to sue and be sued
in its own name.
• The ability of an incorporated association to hold property in its
corporate name without the necessity of appointing trustees.
• The ability of an incorporated association to enter into contracts
in its corporate name.
• The liabilities of an incorporated association are enforceable against
the association and not against the committee members personally.
Generally, the Act applies
to any association (including a society, institution or body) that is formed
or carried on for any lawful object or purpose but not for pecuniary gain
to its members, including such associations as sporting, charitable, community
purpose,, religious,, educational, patriotic and pastime.
Before 928Frenzy Inc was created, the organiser of an event could be sued
if something happened, even if they were not directly involved. In fact,
any person attending the event could be sued and lose their house, car,
etc. How quickly we have forgotten the publicity of a couple of years ago
over liability and insurance, how a group of parents volunteering at a school
sports day were successfully sued by an insurance company when a pupil was
hurt - it is still there!
With 928Frenzy Inc, event organisers and the committee of 928Frenzy Inc
are protected (though any individual who broke the law or damaged property
may still be liable?).
Note that 928Frenzy Inc is a stand-alone entity which may (or may not) be
used by the 928 community including Landsharkoz, it is voluntary (for those
who are concerned about the liability issue).
928Frenzy Incorporated does not have membership fees (yearly registration
is via voluntary contribution or other funds raised).
